ABOUT US

Out of Court keeps you in control.

At Out of Court, we believe that divorce shouldn’t just be about the divorce, it should be about your life after. Our mission is to help couples navigate separation with dignity, fairness, and mutual respect – all while keeping you in control of your own future.

Our Mission

Our mission at Out of Court is to transform the divorce process from a battlefield into a pathway to new beginnings. We believe the best way to end a marriage is to help prepare you for your new life after.

Our Values

At Out of Court, our values aren’t just words on a page – they’re the principles that guide every interaction, decision, and service we provide. Our core belief in empowering and enabling people shapes how we help couples navigate one of life’s most challenging transitions.

Our Approach

We understand that ending a marriage is one of life’s most challenging transitions. That’s why we’ve pioneered an innovative approach that combines the wisdom of traditional mediation with the accessibility of modern technology.

Why Choose Out of Court?

The traditional legal system is a terrible way to resolve conflicts. The outcome is out of your hands, it’s extremely costly, and it maximizes pain and conflict for everyone involved.

Out of Court can give you a faster, more efficient, less expensive, well-crafted result that fits your goals and your family because you’re empowered to fashion it yourself.

Keep control of your outcome in your own hands.

Going to court puts the final decision about your future in the hands of a judge.

We believe you’re in a better position than a judge to make decisions about your life and your future.

Out of Court removes the uncertainty and the risk, and has higher rates of satisfaction than going to court.

Save up to 96% more money on average.

The average cost of divorce in the U.S. is $15,000 per person, but cases that go to trial frequently cost $50,000-$100,000 in legal bills for each person.

The Out of Court online platform can not only help you get a better outcome, it can do it for a fraction of the cost and in a fraction of the time.

Reduce negative impacts on your children.

Children whose parents reach Out of Court resolutions are less likely to display delinquent behaviors, and experience less depression, anxiety, and other mental health issues associated with divorce.

You know your children better than a judge will ever know them. But a judge will have to make a decision about your and your child’s future after just having talked to both parents and listening to testimony for a couple of hours.

Out of Court is your opportunity to structure the life that works best for your children so they flourish in spite of the divorce.

Who We Are

Our innovative approach comes from our team’s experience and vision.

Our founders have over 60 years of combined professional experience, but just as importantly, our personal stories have been shaped by divorce.  And we believe it’s important to use our own experiences with divorce to help people through one of the most challenging times they’ll face in life.

Brenda Clark

Brenda is a family lawyer with over 40 years of experience in the courtroom.  She is a former Assistant Attorney General for the State of Tennessee, and began practicing family law while she was in the middle of her own divorce.

She found herself able to relate to what her clients were going through because she was going through it too, and it helped her do a better job because she had a different way of listening to people. She realized she had a real ability and a passion to help people going through one of the toughest times they’ll experience in life.

Joshua Little

Joshua is the author of two books and workbooks on preparing for divorce and has over 20 years of experience as a legal operations consultant and in private business. He has a passion for and a track record of finding smarter, more efficient ways of doing things.

He has helped prepare complex litigation for trial in areas of law including divorce, child custody, and parental alienation, and was trained in Mediation and Alternative Dispute Resolution at Lipscomb University in Nashville, TN.

He is also the child of a contentious divorce, and cares deeply about helping people, particularly children, limit the pain and negative outcomes from divorce.
